Please read these terms and conditions carefully before using Exam Beacon. Your use of the service is subject to your acceptance of and compliance with these terms (the "Terms"). By creating an account, subscribing to, or using any part of our service, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not use the service.
In these Terms, "you" and "User" mean the parent, guardian or other adult who registers for and manages an account and who is responsible for any child who uses the service under that account. "We", "us" and "our" mean Exam Beacon, a service operated by Exam Papers Plus Ltd. "Service" means the Exam Beacon website, platform and all features made available through them, including the AI study companion.
1. About us
Exam Beacon is operated by Exam Papers Plus Ltd, a company incorporated in England and Wales (company number 09089974), with its registered office at 40 Bowling Green Lane, London, EC1R 0NE, United Kingdom. Exam Beacon is an online platform that helps children aged 8 to 11 prepare for 11+ exams, including through an AI study companion and related learning and assessment features.
2. Accounts, eligibility and children
- Exam Beacon is intended for use by children aged 8 to 11, but accounts may only be created and managed by a parent, guardian or other responsible adult aged 18 or over. By creating an account you confirm that you are such an adult and that you have authority to enter into these Terms on behalf of yourself and any child you add to the account.
- You are responsible for the child's use of the service, for supervising that use as appropriate, and for all activity that takes place under your account.
- You are responsible for keeping your account details and password confidential and for all activity that occurs under your account. You agree to notify us promptly at policy@exambeacon.com of any unauthorised use of your account or any other breach of security, and to ensure you log out at the end of each session.
- We may refuse to register an account, or suspend or close an account, at our reasonable discretion, for example where these Terms have been breached.
3. The service
- Exam Beacon provides online learning and assessment tools for 11+ exam preparation, including an AI study companion that responds to a child's questions and work, marking and feedback features, and related practice materials.
- We may add, change, suspend or remove features of the service from time to time in order to improve it or for operational, legal or security reasons.
4. The AI study companion
- The AI study companion generates responses automatically. While we work hard to make it helpful, accurate and age appropriate, AI generated content can sometimes be incomplete, inaccurate or unexpected. Responses should be treated as study support, not as a guarantee of exam outcomes and not as a substitute for teaching, professional or medical advice.
- We recommend that a parent or guardian remains involved in the child's use of the AI study companion and reviews its feedback where appropriate.
- You agree not to rely on the AI study companion as the sole basis for any important decision, and you accept that exam results depend on many factors outside our control.
5. Safeguarding
The welfare of the children who use Exam Beacon matters to us. Where a child's messages or activity suggest a possible risk to their safety or wellbeing, we may respond in line with our safeguarding procedures, which can include providing supportive signposting, notifying the account holder, or, where appropriate and in line with our legal obligations, contacting relevant authorities. Our handling of personal data in this context is explained in our Privacy Policy.
6. Acceptable use
You agree, and you agree to ensure that any child using your account, to use the service responsibly and lawfully. In particular you will not:
- defame, abuse, harass, threaten or otherwise violate the legal rights of others;
- submit or share any unlawful, infringing, obscene, indecent, offensive or otherwise inappropriate material;
- upload files containing viruses, malware or other harmful code, or otherwise attempt to disrupt or compromise the service;
- attempt to reverse engineer, copy, scrape, resell, sublicense or commercially exploit any part of the service or its content;
- use the service to develop, train or improve any other product or machine learning model;
- share account access with anyone outside your household or use a single account for children other than your own; or
- breach any applicable law or regulation, or any of these Terms.
7. Intellectual property
- Except for content you provide, we (or our licensors) own all intellectual property rights in the service and its content, including the platform software, text, graphics, practice materials, designs, trade marks and the Exam Beacon name. You are granted a limited, personal, non transferable and revocable licence to access and use the service and its materials for the personal, non commercial educational use of the child or children on your account. Use of the materials for tuition of other children, or any form of distribution, resale or commercial use, is not permitted.
- You retain ownership of any content you or your child submit to the service (for example answers, written work or messages). By submitting content you grant us a non exclusive, worldwide, royalty free licence to host, store, process and use that content as needed to provide, maintain, secure and improve the service, and as otherwise described in our Privacy Policy. You confirm that you have the right to submit that content and that it does not infringe the rights of any third party.
8. Pricing, subscriptions and payment
- Prices for the service are set out on our website and are incorporated into these Terms by reference. All prices are in British pounds and include VAT where applicable.
- Subscriptions and access are offered on a per-learner basis. Each learner account operates on one of the following plans, the current prices for which are set out on our website:
- Free plan: includes a diagnostic assessment and one practice session, at no charge. No payment is required.
- Core plan: a monthly subscription providing five practice sessions per week. Sessions reset each Monday at midnight (London time). The subscription renews automatically on the same date each month until you cancel. If you cancel, you will receive a refund of 50% of the current month's subscription fee and the learner's account will revert to the Free plan immediately.
- ToExam plan: a one-off payment providing unlimited practice sessions until 31 December 2026. Access ends at midnight on that date, after which the learner's account reverts to the Free plan automatically. Cancellation is available within 14 days of purchase, in which case a refund of 50% of the purchase price will be issued. No refunds are available after the 14-day window.
Payment is collected at the point of purchase via our payment provider, Stripe. For the Core plan, payment is collected automatically at the start of each billing period. You will not receive a separate renewal reminder unless required by applicable law. - We may change our prices from time to time. Where a change affects an existing subscription, we will give you reasonable notice before it takes effect.
- Any discount code or offer is subject to its own conditions, and a maximum of one code may be applied per transaction unless stated otherwise.
9. Cancellation and refunds
- As a consumer you have certain statutory rights, including, in most cases, a right to cancel within 14 days of entering into the contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. When you purchase a Core or ToExam plan, you will have immediate access to the service. By proceeding with a purchase you acknowledge that you are requesting immediate access to digital content and agree that, as a result, your right to cancel within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 is lost once access has begun. In place of that statutory right, we offer the refund terms set out in Section 8 above, which apply from the moment of purchase.
- You can cancel your subscription at any time from the Plan & Billing section of your account settings. For the Core plan, cancellation takes effect immediately and the learner's account reverts to the Free plan. For the ToExam plan, cancellation is only available within 14 days of purchase. In both cases, refunds are processed in line with Section 8 and will appear on your card within 5 to 10 business days.
- Nothing in these Terms affects your statutory rights as a consumer.
- If you are unhappy with the service or experience a technical problem, please contact us at policy@exambeacon.com and we will do our best to put things right. If we cannot resolve a complaint between us, this does not affect your statutory rights, and you can seek independent advice, for example from Citizens Advice.
10. Links to third party sites
The service may contain links to other websites that we do not control. We are not responsible for the content, accuracy or practices of those sites, and the inclusion of a link does not imply our endorsement. You access third party sites at your own risk and subject to their own terms.
11. Disclaimer and limitation of liability
- We provide the service with reasonable care and skill, but, except as expressly set out in these Terms and as required by law, the service is provided on an "as is" and "as available" basis and we make no warranties about its accuracy, completeness, uninterrupted availability or fitness for a particular purpose.
- We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that cannot be excluded under English law (including your statutory rights as a consumer).
- Subject to the paragraph above, we will not be liable for any loss or damage that is not reasonably foreseeable, for any loss arising from your or a child's failure to follow these Terms, or for events outside our reasonable control, including periods when the service is unavailable for maintenance or technical reasons.
12. Indemnification
You agree to indemnify and hold us harmless from any losses, liabilities, claims, damages, costs and reasonable expenses arising out of your breach of these Terms or your or a child's misuse of the service, to the extent permitted by law and except where such losses result from our own negligence or breach.
13. Termination
- We may suspend or end your access to the service if we reasonably believe you have breached these Terms or that suspension is necessary to protect the service, other users or a child's safety.
- You may stop using the service and close your account at any time, subject to the subscription and cancellation terms above.
- On termination, we may delete content and materials relating to your use of the service in line with our data retention practices and the Privacy Policy. Termination does not affect any amounts already due.
14. Privacy
Our collection and use of personal data is described in our Privacy Policy and Cookie Policy, which form part of your agreement with us. Because the service is used by children, we apply heightened protections in line with the ICO Age Appropriate Design Code (the Children's Code).
15. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes to the service or the law. We will post the updated Terms on our website and update the "Last updated" date, and where changes are significant we will take reasonable steps to let account holders know.
16. Governing law
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
17. General
- Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
- Headings. Headings are for convenience only and do not affect interpretation.
- Interpretation. Words such as "include" and "including" are to be read without limitation.
- Entire agreement. These Terms, together with our Privacy Policy and Cookie Policy, form the entire agreement between you and us relating to the service, and replace any earlier agreements or understandings about it.
- No waiver. If we do not insist that you perform any of your obligations under these Terms, or if we delay in enforcing our rights against you, that does not mean we have waived our rights or that you do not have to comply with those obligations.
- Assignment. We may transfer our rights and obligations under these Terms to another organisation, for example if our business is reorganised or sold, and we will tell you in advance if this happens. You may not transfer your rights or obligations under these Terms to anyone else without our written consent.
- Third-party rights. These Terms are between you and us. No other person has any right to enforce any of these Terms under the Contracts (Rights of Third Parties) Act 1999.
